O artigo apresenta uma visão de conjunto do pensamento de Lima Vaz, a partir de seu método original, caracterizado por seu cunho rememorativo, dialético e sistemático. Ele é aplicado particularmente na Antropologia Filosófica e na Ética, sintetizando a categoria de história com a de transcendência, superando assim a crise do pensamento moderno à luz da práxis ética.

O artigo trata da primeira da fase, bem mais breve, do pensamento filosófico de Lima Vaz, reconhecido como um dos principais filósofos de sua geração no Brasil. Depois de fornecer algumas indicações sobre sua formação intelectual, detém-se na sua reflexão sobre as condições de reconciliação entre a mensagem cristã e o pensamento moderno através de seus artigos sobre “consciência histórica”, visando resgatar o verdadeiro sentido da modernidade. Analisa também a aplicação feita por ele dessas ideias à solução dos graves problemas (...) da sociedade brasileira então em debate, bem como a repercussão pública de sua proposta num momento decisivo da história nacional. Discute em seguida se ele com isso se mostra então favorável a um pensamento cristão alternativo à metafísica tradicional, concluindo por uma provável negativa. (shrink)

As relações Estado-Religião têm sido regidas na modernidade pelo princípio da laicidade do Estado. Esta laicidade assumiu, muitas vezes, o caráter de negação dos valores transcendentes, sob a capa de neutralidade do Estado. Tal posição se explica pela origem do Estado laico como reação à influência dominante das Igrejas cristãs sobre toda a vida social, no período anterior à Revolução Francesa. Ora, esta contraposição entre as esferas religiosa e política perdeu qualquer sentido no mundo atual, pelo menos, no Ocidente. Com (...) efeito, as mudanças culturais advindas com a secularização da sociedade reclamam - está é a proposta do artigo - um novo modelo de laicidade, segundo o qual o Estado, longe de pretender impor aos cidadãos uma determinada visão do mundo, pretensamente científica, mas, na verdade, ideológica, promova a participação de todas as forças vivas da nação, em particular, das comunidades religiosas, no debate público sobre as questões de interesse comum, sobretudo no seu aspecto ético. Official secularism has often assumed the denial of transcendent values, under cover of State neutrality. This position can be explained in view of the origins of the secular State as a reaction against the hegemonic social influence of Christian Churches prior to the French Revolution. The opposition between the religious and political spheres, however, has lost all meaning in today's world, at least in the West. In fact, as this article intends to show, the cultural changes arising precisely from the secularization of society require a new model of secular State, wherein the State should not seek to impose on its citizens a certain worldview which, although purportedly scientific, would in fact be ideological. On the contrary, it should promote the participation of all of civil society, and of the nation's religious communities in particular, in the public debate about issues of common interest, especially regarding their ethical aspects. INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what (...) was written in one language be accessible in another. And that a translator is to serve as a mediator, acting ultimately in service to ideas within the source text. To disperse them. However, this notion of translation is partly antithetical to the ideas in Rosa’s work. Or, alternately, to convey the despair of terrain slipping beneath one’s feet, and to encounter the heightened suspense of magic, the translation, as part of its strategy, cannot devotedly rely on its original language, not as its source text. The work undertaken by Felipe W.Martinez is a new form of translation that risks everything in order to encounter the same treacherous knowing Rosa had traversed. And it takes its risks by not taking risks: by being, almost word for word, a literal translation. This is an approach that reductively converts, as opposed to translates. The idiomatic differences between English and Portuguese are not accented. The syntax is not finessed. Liberties are not assumed on account of improving readability. What stands, resoundingly amid such absences, is the awakened challenge of reading. The genuine peril of not knowing. That is, this translation, one that purports to know nothing, creates access into the guileful world Rosa had created in Portuguese. But not by translating. If anything, GRANDE SERTÃO: VEREDAS is speaking a cosmic language through a linguistic one. And W.Martinez does us the service of recognizing this, as what configures the shapes of words and sentences is not as simple as neologisms, portmanteaus, and digressions, but as terrifying as the path the fool traverses: all paths. As such, this translation doesn’t speak English, just as the original does not speak Portuguese. It is the assemblage of paradox as a new logic that can be navigated, if only one could suspend the comfort of readability, of expectation. If one could descend a mountain in the pitch dark of night, each step shocking the body, unable to acclimate to the unleveled heights. Without a doubt, the translation is incongruous to the Portuguese. Taking a small excerpt to compare: Eh, well, thereafter, the rest the Sir provide: comes the bread, comes the hand, comes the god, comes the dog. What is striking is the interplay between “god” and “dog”. To most English speakers, this anagram is a familiar one. But in Portuguese the words god (“deus”) and dog (“cão”) are not so closely linked. In fact, there is no direct mention of “deus” in Rosa’s text: Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Both are fascinating. In Rosa’s excerpt, the rhythm is unmistakable and precise, despite, of course, the indices of hesitation: the commas, the Eh, the uncomfortable way of searching through prolongation and wait. This is the sort of paradox Rosa can engage within a sentence. W.Martinez’s does this as well, at a scale that reverberates beyond the sentence, and with one noticeable addition: deus. What may appear to be an overstep, to add such a weighted word that draws out wordplay but is, nevertheless, not in the source text, is exemplary of risk. The translation buzzes because of it. This is because throughout the text we encounter dogs frequently, as some primal beast on par with humans. The dog is one that masters and can be mastered. A creature that is at times its face, and at others a mask. It is a powerful presence. For the translator to be attuned to the reverent undercurrent attributed to this animal, and create within the translation such charged play in English from what was only an implication in Portuguese, is in tribute to the grand beauty within dissonance. What aberrant modes of writing and translation can teach us most assuredly, is that things, words, are not in states of rightness or wrongness, but of oscillation. This isn’t so different from what Rosa says himself: The Sir look…see: the most important and beautiful, of the world, is this: that the people are not always same, still were not completed — but that they go always shifting. They tune or detune. We find this so readily in W.Martinez’s translation, this tuning and detuning. Me agradou que perto da casa dele tinha um açudinho, entre as palmeiras, com traíras, pra-almas de enormes, desenormes, ao real, que receberam fama; o Aleixo dava de comer a elas, em horas justas, elas se acostumaram a se assim das locas, para papar, semelhavam ser peixes ensinados. Um dia, só por graça rústica, ele matou um velhinho que por lá passou, desvalido rogando esmola. O senhor não duvide – tem gente, neste aborrecido mundo, que matam só para ver alguém fazer careta... Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Esse Aleixo era homem afamilhado, tinha filhos pequenos; aqueles eram o amor dele, todo, despropósito. Dê bem, que não nem um ano estava passado, de se matar o velhinho pobre, e os meninos do Aleixo aí adoeceram. Andaço de sarampão, se disse, mas complicado; eles nunca saravam. Quando, então, sararam. Mas os olhos deles vermelhavam altos, numa inflama de sapiranga à rebelde; e susseguinte – o que não sei é se foram todos duma vez, ou um logo e logo outro e outro – eles restaram cegos. Cegos, sem remissão dum favinho de luz dessa nossa! O senhor imagine: uma escadinha – três meninos e uma menina – todos cegados. Sem remediável. O Aleixo não perdeu o juizo; mas mudou: ah, demudou completo – agora vive da banda de Deus, suando para ser bom e caridoso em todas suas horas da noite e do dia. E o velhinho assassinado? – eu sei que o senhor vai discutir. Pois, também. Em ordem que ele tinha um pecado de crime, no corpo, por pagar. Se a gente – conforme compadre meu Quelemém é quem diz – se a gente torna a encarnar renovado, eu cismo até que inimigo de morte pode vir como filho do inimigo. This paper discusses two notational variance views with respect to indexical singular reference and content: the view that certain forms of Millianism are at bottom notational variants of a Fregean theory of reference, the Fregean Notational Variance Claim; and the view that certain forms of Fregeanism are at bottom notational variants of a direct reference theory, the Millian Notational Variance Claim. While the former claim rests on the supposition that a direct reference theory could be easily turned into a particular (...) version of a neo-Fregean one by showing that it is bound to acknowledge certain senselike entities, the latter claim is based upon the supposition that a neo-Fregean theory could be easily turned into a particular version of a Millian one by showing that De Re senses are theoretically superfluous and hence eliminable. The question how many accounts of singular reference and content are we confronted with here — Two different (and mutually antagonistic) theories? Or just two versions of what is in essence the same theory? — is surely of importance to anyone interested in the topic. And this question should be answered by means of a careful assessment of the soundness of each of the above claims. Before trying to adjudicate between the two accounts, one would naturally want to know whether or not there are indeed two substantially disparate accounts. Grosso modo, if the Fregean Claim were sound then we would have a single general conception of singular reference to deal with, viz. Fregeanism; likewise, if the Millian Claim were sound we would be facing a single general conception of singular reference, viz. Millianism. My view is that both the Fregean Notational Variance Claim and its Millian counterpart are wrong, though naturally on different grounds. I have argued elsewhere that the Fregean Notational Variance Claim - considered in its application to the semantics of propositional-attitude reports involving proper names — is unsound. I intend tosupplement in this paper such a result by trying to show that the Millian Claim - taken in its application to the semantics of indexical expressions — should also be rated as incorrect. I focus on a certain set of arguments for the Millian Claim, arguments which I take as adequately representing the general outlook of the Millian theorist with respect to neo-Fregeanism about indexicals and which involve issues about the cognitive significance of sentences containing indexical terms. The COVID-19 pandemic has led to the widespread use of online hearings in arbitral proceedings, raising questions about the impact of such proceedings on the determination of facts underlying a dispute. This article explores the extent to which online hearings may hinder arbitrators’ ability to assess witness credibility by drawing upon the cognitive psychology literature on truthfulness determination and lie detection. A survey of the literature suggests that the ability to differentiate truthful from dishonest statements through verbal and nonverbal cues (...) is limited, leading to the notion that observing behaviors like fidgeting, gaze aversion, vocal pitch, or body posture is not particularly relevant in assessing the credibility of a witness. Instead, focusing on the content of what is reported appears to be the most relevant strategy to determine credibility. Therefore, research does not support the idea that face-to-face contact with witnesses is essential to determine the facts of a dispute. Still, the use of in-person hearings may, in practice, continue to be preferred due to underlying cultural assumptions regarding the nature of hearings, the facilitation of communication between parties, counsel, and the tribunal, and a general sense of _Zoom fatigue_. On Kratzer’s canonical account, modal expressions (like “might” and “must”) are represented semantically as quantifiers over possibilities. Such expressions are themselves neutral; they make a single contribution to determining the propositions expressed across a wide range of uses. What modulates the modality of the proposition expressed—as bouletic, epistemic, deontic, etc.—is context.2 This ain’t the canon for nothing. Its power lies in its ability to figure in a simple and highly unified explanation of a fairly wide range of language use. Recently, (...) though, the canon’s neat story has come under attack. The challenge cases involve the epistemic use of a modal sentence for which no single resolution of the contextual parameter appears capable of accommodating all our intuitions.3 According to these revisionaries, such cases show that the canonical story needs to be amended in some way that makes multiple bodies of information relevant to the assessment of such statements. Here I show that how the right canonical, flexibly contextualist account of modals can accommodate the full range of challenge cases. He showed how the political action of his contemporaries was something excessively ineffective to answer the wishes of a fair society, integrated by several people and races. This society, that had conquered in history, with mistakes and cleverness, power and glory, booth in the field of science and technology, for itself, the ways that (...) make sure to its citizens a prosper life, gradually succumbed. Thus, this article aims to exposes to the reader some aspects experienced by this society and make note that when policy is practiced by men who possess as premises the power and his own advantages, there is no richness or organization that will sustain such state or nation. According to a recent challenge to Kratzer's canonical contextualist semantics for deontic modal expressions, no contextualist view can make sense of cases in which such a modal must be information-sensitive in some way. Here I show how Kratzer's semantics is compatible with readings of the targeted sentences that fit with the data. I then outline a general account of how contexts select parameter values for modal expressions and show, in terms of that account, how the needed, contextualist-friendly readings might plausibly (...) get selected in the challenge cases. Our goal here is to help identify the contextualist’s most worthy competitor to relativism. Recently, some philosophers of language and linguists have argued that, while there are contextualist-friendly semantic theories of deontic modals that fit with the relativist’s challenge data, the best such theories are not Lewis-Kratzer-style semantic theories. If correct, this would be important: It would show that the theory that has for many years enjoyed the status of the default view of modals in English and other languages is (...) in need of revision. Here we defend the default view by showing how a Kratzer-style semantics is able to make available readings of the relevant utterances that fit with the pretheoretical judgments opponents purport it cannot fully capture. Having established this, we turn to considering the more theoretical grounds proponents have offered for preferring their rival contextualist views. Here the question is to what extent such grounds favor semantic over what Korta and Perry call “near-side pragmatic” explanations of our judgments. In particular, we argue that our favored readings figure in near-side pragmatic explanations of those judgments that possess the methodological and theoretical advantages of systematicity and unity at least as well as, if not to a greater extent than, those of opponents who argue for their revised semantic theories on the basis of these advantages. It is often said nowadays that to understand pleasure we must understand it as affording us a reason for or an explanation of action. It is only from the standpoint of the agent that we can avoid being misled. Both Professor Nowell-Smith and Mr. Manser have argued along these lines; and Dr. Kenny has written that “pleasure is always a reason for action” and has elucidated what he means by a footnote: “I do not mean that a thing’s being pleasant (...) is always a sufficient reason for doing it; there may be strong reasons for abstaining. I mean merely that it is always silly to ask a man why he wants pleasure.” When I first saw this point made, I had the perhaps not uncommon philosophical experience of immediately finding it both lucid and convincing, but then, afterwards gradually becoming less and less clear about the source of my conviction. The reasons for my obfuscation are as follows. In one crucial sense anything can afford an agent with a reason for action. It depends upon what the agent wants and upon the projects in which he is engaged. Moreover, without having any strong reasons for abstaining from what will give me pleasure, I may not be at all moved by the prospect of pleasure. As I write this paper I can list a dozen activities or experiences which would afford me pleasure. I have no strong reason for abstaining; I do not particularly enjoy writing papers; I am not writing with a great sense of urgency; I have the time and the money to indulge myself. Yet I do not rush to open a Guinness or Mr. Alfred Grossman’s new novel. So that far from it being silly to ask me why I do not apparently want pleasure at the moment, it is a question that I find forced upon me. But if this question makes sense, there is at least a problem as to why “it is always silly to ask a man if he wants pleasure.” For one might expect the two questions to stand or fall together. This is the problem to which I address myself in this paper. But in order to do so I must first take up certain points from recent discussions which are in danger of preventing a solution. (shrink)

In this paper, we intend to discuss how, according to Peirce’s semiotics, gestures can be conceptualized and described as diagrams. We are not concerned with answering when, why or how gestures emerged as semiotic motor activities. As a prerequisite for the very formulation of these problems, we are rather interested in discussing the theoretical conditions which should be fulflled for gestures to be characterized as iconic processes - and more specifcally as diagrammatic processes. The frst step is to summarize a (...) systematic analysis of the variety of iconic signs, elaborated by Peirce, followed by his typology of hypoicons in order to describe the hypoiconic class of diagrams. After that, we present some tentative answers to the question of how to describe gestures as diagrammatic signs. (shrink)

Finance is an area that, in practice, is plagued by accusations of unethical activity; the study of finance had adopted a largely nonbehavioral approach to business ethics research. We address this gap in by assessing whether individual ethical orientations predict the acceptability of questionable decisions about financial issues. Results show that individual ethical orientations are associated with different levels of acceptability of questionable decisions about financial issues, though the pattern of these differences varies across individual ethical orientations assessed. These results (...) represent evidence that ethical individual differences are associated with the acceptability of questionable finance decisions and are discussed in terms of methodological limitations and future directions in finance ethics research. Cause-related marketing has risen to become a popular strategy to increase business value through profit-motivated giving. Despite the growing number of articles published in the last decade, no comprehensive analysis of the most discussed constructs of cause-related marketing is available. This paper uses an advanced Text Mining methodology to conduct a comprehensive analysis of 246 articles published in 40 different journals between 1988 and 2013 on the subject of cause-related marketing. Text Mining also allows quantitative analyses to be performed on (...) the literature. For instance, it is shown that the most prominent long-term topics discussed since 1988 on the subject are “brand-cause fit”, “law and Ethics”, and “corporate and social identification”, while the most actively discussed topic presently is “sectors raising social taboos and moral debates”. The paper has two goals: first, it introduces the technique of CTM to the Marketing area, illustrating how Text Mining may guide, simplify, and enhance review processes while providing objective building blocks to be used in a review; second, it applies CTM to the C-RM field, uncovering and summarizing the most discussed topics. This chapter discusses three puzzles about practical conditionals and inferences and shows how the flexible, contextualist semantic framework for “ought”. The chapter develops elsewhere resolves all three puzzles more satisfactorily than any of its three most prominent rivals, the relativist account of Niko Kolodny and John MacFarlane, the wide-scoping account of John Broome, and the “trying on” account of James Dreier. The chapter first introduces the puzzle cases and six desiderata for their solutions, and then shows how only flexible contextualism (...) about “ought” is able to resolve each while satisfying all six desiderata. On elective students may not always be clear about safeguarding themselves and others. It is important that placements are safe, and ethically grounded. A concern for medical schools is equipping their students for exposure to and response to uncomfortable and/or unfamiliar requests in locations away from home, where their comfort and safety, or that of the patient, may be compromised. This can require legal, ethical, and/or moral reasoning on the part of the student. The goal of this article is to (...) establish what students actually encounter on elective, to inform better preparing students for safe and ethical medical placements. We discuss the implications of our findings, which are arguably applicable to other areas of graduate training, e.g. first medical roles post-qualification. An anonymised survey exploring clinical and ethical dilemmas on elective was issued across 3 years of returning final year elective medical students. Questions included the prevalence and type of potentially unsafe scenarios encountered, barriers to saying ‘no’ in unsafe situations, perceived differences between resource poor and developed world settings and the degree to which students refused or consented to participation in events outside of the ‘norms’ of their own training experience. Three hundred seventy-nine students participated. 45% were asked to do something “not permissible” at home. 27% were asked to do something they felt “uncomfortable” with, often an invasive clinical task. Half asked to do something not usually permissible were “comfortable”. 48% felt it more acceptable to bypass guidelines in developing settings. 27% refused an offer outside their experience. Of interest are reasons for “going along with” uncomfortable invitations, e.g. “emergency”, self-belief in ‘capability’ and being ‘more qualified’ than host-personnel. This “best pair of hands available” merits scrutiny. Adverse scenarios were not exclusive to developing settings. We discuss preparing students for decision-making in new contexts, and address whether ‘home’ processes are too inflexible to prepare students for ‘real’ medical life? Ethical decision-making and communicating reluctance should be included in elective preparation. (shrink)

No livro dois da Ética Nicomaqueia, Aristóteles afirma com clareza que a prática reiterada de ações virtuosas leva à constituição de uma determinada disposição de caráter, ou seja, o hábito funcionaria como uma segunda natureza, em função da fixidez e estabilidade da disposição por ele constituída, o que aparentemente impediria qualquer modificação no que concerne ao caráter. O problema é que várias passagens do Corpus Aristotelicum parecem contradizer esta asserção, permitindo uma leitura diferente daquela que sugeriria a ideia do hábito (...) como algo que operasse de modo similar à natureza. Este artigo propõe-se investigar se é possível uma leitura que permita, nas Éticas, bem como em outras obras do Corpus Aristotelicum, a possibilidade da mudança de caráter, da decadência ou da reforma moral, bem como sua implicação na investigação sobre o problema do determinismo e da responsabilidade moral. O jornal Tribuna Criciumense foi o único impresso publicado na cidade de Criciúma no período deste escrito. Fundado em 1955, ele passou por três fases. Na primeira, produziu um discurso anticomunista, mas de maneira um pouco tímida. Na segunda fase, com curta duração, o impresso passou a valorizar a ideologia comunista e, ao mesmo tempo, a defesa do presidente João Goulart. A última fase foi marcada por ataques violentos contra o comunismo, em defesa do golpe civil-militar e da ditadura (...) implantada. Analisar essas fases e como os discursos anticomunista e pró-comunismo reverberaram no jornal se configura no objetivo deste escrito. (shrink)

Brazil is among the approximately 100 countries that recognize a constitutional right to health that includes access to medicines. All over Brazil, patients are turning to courts to access prescribed medicines. Although lawsuits secure access for thousands of people, at least temporarily, this judicialization of the right to health generates intensely complex sociomedical realities and significant administrative and fiscal challenges that, officials argue, have the potential to widen inequalities in health-care delivery. In this article, we explore how right-to-health litigation became (...) an alternative pathway for Brazilians to access health care, now understood as access to medicines that are either on government lists for pharmaceutical distribution or are only available through the market. Is the judicial system an effective venue to implement socioeconomic rights? This paper briefly examines the concept of the ancient mode of production as expressed in Karl Marx’s Formations. It looks at how twentieth-century Marxist historiography picks up this concept in its characterisation of the Greco-Roman city-state. It explores the feasibility of the use of the concept in relation to the advancement of knowledge of the city-state, especially through the development of archaeology. It examines how social classes are structured and relations of exploitation are presented. We argue that Parfit's "Triviality Objection" against some naturalistic views of normativity is not compelling. We think that once one accepts, as one should, that identity statements can be informative in virtue of their pragmatics and not only in virtue of their semantics, Parfit's case against naturalism can be overcome.
